Litigation in family and matrimonial law refers to disputes that may arise between spouses or family members. These include divorce and custody, inheritance and the protection of vulnerable persons.

Divorce

Divorce can be filed for numerous reasons, such as disagreement between the spouses, adultery, abandonment of the marital home, domestic violence, etc. Divorce disputes may concern a number of different issues, such as :

  1. Child custody
  2. Child support
  3. Property settlement and distribution of debts
  4. Visitation and accommodation arrangements for the children
  5. Alimony in favour of one of the spouses

Estate

Legal disputes concerning the estate of a deceased person. Possible avenues for resolving these disputes may include mediation, conciliation, or court action.
Disputes over inheritance matters may relate to a number of issues, such as

  1. The legitimacy of a will or gift
  2. The determination of heirs
  3. Distribution of the estate among the heirs
  4. The distribution of assets and debts
  5. Inheritance fraud (concealment of inheritance assets)

Protection of vulnerable persons

These are legal or administrative procedures designed to protect the rights and interests of people considered vulnerable because of their age, state of mental or physical health, disability or social situation.

Child protection: these are procedures that aim to protect the rights and interests of children in danger or at risk of danger. This may include measures such as educational assistance, placement with a foster family or in a specialised establishment, or revocation of parental authority.

Protection of incapacitated adults: These are measures designed to protect the rights and interests of adults who are considered incapable of managing their own affairs due to a disability, mental illness or impairment of their mental faculties. This may include guardianship, curatorship or protection under the law.
